Welcome to The Lessons & The Laughter! The terms "we", "us" and "our" refer to The Lessons & The Laughter. We operate this website and provide podcast recording and production services to help individuals — particularly older Australians — capture and preserve their personal stories, memories, and life experiences (the "Services").
The Lessons & The Laughter is powered by Squarespace, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use our Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, booking, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ELIGIBILITY AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or that you are a legal guardian booking on behalf of someone else and have the authority to do so.
To book our Services, you will be asked to provide certain personal information, including your name, email address, and payment details. You represent and warrant that all information you provide is accurate, current, and complete.
You are solely responsible for maintaining the confidentiality of any account credentials and for all activity associated with your account. You may not transfer or assign your account to any other person.
SECTION 2 - OUR SERVICES
The Lessons & The Laughter offers podcast recording and production sessions in which clients share their personal stories, memories, and life experiences. Our Services include:
A recorded podcast session (conducted via video or phone call, or in person as agreed);
Post-session audio editing and production; and
Delivery of both the raw (unedited) and edited audio files to the client.
We take great care to create a warm, comfortable, and professionally produced experience. However, we do not guarantee any specific outcome, audience reach, or third-party publication of your recordings.
All session formats, inclusions, and delivery timelines will be confirmed in writing at the time of booking. We reserve the right to update or change our service offerings at any time, but any changes will not affect bookings already confirmed.
Our Services are personal and storytelling in nature only. They do not constitute professional advice of any kind, including legal, financial, medical, or psychological advice. If you require such advice, we encourage you to consult a qualified professional.
SECTION 3 - BOOKINGS AND CANCELLATIONS
When you submit a booking request, you are making an offer to purchase our Services. Your booking is not confirmed until you receive a written confirmation from us and payment has been received.
We reserve the right to decline any booking request at our discretion. In the event we are unable to accommodate your booking, we will notify you promptly and provide a full refund of any payment made.
Cancellations by you:
Cancellations made more than 7 days before your scheduled session will receive a full refund.
Cancellations made within 7 days of your scheduled session will be charged the full session fee.
No-shows (failure to attend without prior notice) will be charged the full session fee.
Cancellations by us:
In the unlikely event that we need to cancel or reschedule your session, we will provide as much notice as possible and offer you a full refund or alternative booking time, at your preference.

SECTION 4 - PRICING AND PAYMENT
All prices are listed in Australian dollars (AUD) and are inclusive of GST unless otherwise stated.
Payment is required prior to or at the time of your session, unless alternative arrangements have been agreed in writing. We accept payment via the methods listed on our website, including major credit and debit cards and bank transfer.
Prices are subject to change without notice. The price applicable to your booking will be the price confirmed at the time of your booking.
Invoices will be issued through our Squarespace invoicing system and must be paid by the due date specified. Overdue payments may result in the withholding of your audio files until payment is received in full.
SECTION 5 - DELIVERY OF FILES
Following your session, we will deliver your raw and edited audio files digitally via email or a secure file sharing link within the timeframe agreed at the time of booking (typically within 7–14 business days of your session, unless otherwise agreed in writing).
Delivery times are estimates only and may be affected by factors outside our reasonable control. We will notify you as soon as practicable if there is any delay.
It is your responsibility to download and save your files upon receipt. We will endeavour to retain copies of your files for a reasonable period, but we cannot guarantee indefinite storage and accept no liability for any loss of files after delivery.
SECTION 6 - INTELLECTUAL PROPERTY AND FILE OWNERSHIP
Upon receipt of full payment, you own the audio files delivered to you. You are free to use, share, distribute, and publish your recordings as you see fit.
All other content on our website — including text, images, graphics, logos, branding, and the design of the site — is owned by The Lessons & The Laughter or its licensors and is protected by applicable Australian and international copyright laws. You may not reproduce, distribute, or use our website content without our prior written consent.
Squarespace's name, logo, and related trademarks are the property of Squarespace Inc. All other third-party names and trademarks referenced on our site are the property of their respective owners.
If you share your story publicly and wish to credit The Lessons & The Laughter, we warmly welcome it — but it is entirely at your discretion.
SECTION 7 - YOUR CONTENT AND CONSENT
You are solely responsible for the content of your recording. By participating in a session, you confirm that:
You have the right to share the stories, memories, and information you provide;
Your content does not defame, harm, or unlawfully disclose private information about any third party; and
You consent to the recording of your session for the purposes of producing your audio files.
We will not use, share, publish, or distribute your recordings without your explicit written consent. Your story belongs to you.
If you choose to share testimonials, feedback, or reviews about your experience with us, you grant us a non-exclusive, royalty-free licence to use that feedback for promotional purposes (e.g. on our website or social media). We will always seek your permission before doing so.
SECTION 8 - THIRD-PARTY TOOLS AND LINKS
Our website and Services may include links to third-party websites or use third-party tools (such as scheduling, payment, or file delivery platforms). We are not responsible for the content, privacy practices, or reliability of any third-party services.
Your use of any third-party tools or platforms is governed by their own terms and conditions. We encourage you to review these before engaging with them.
SECTION 9 - RELATIONSHIP WITH SQUARESPACE
Our website is hosted and powered by Squarespace. However, all bookings and transactions are made directly with The Lessons & The Laughter. Squarespace is not responsible for any aspect of the services provided to you by us, and you hereby release Squarespace and its affiliates from any claims arising from your use of our Services.
SECTION 10 - PRIVACY
All personal information we collect is handled in accordance with our Privacy Policy, which is available on our website. We are committed to protecting your privacy and handling your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles.
By using our Services, you acknowledge that certain information may also be processed by Squarespace in accordance with their privacy policy, available at squarespace.com.
SECTION 11 - AUSTRALIAN CONSUMER LAW
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the ACL or any other applicable Australian law that cannot be excluded by agreement.
SECTION 12 - DISCLAIMER OF WARRANTIES
To the extent permitted by law, our Services are provided "as is" and "as available." We make no representations or warranties that our Services will meet your specific expectations beyond what is expressly agreed at the time of booking.
We do not warrant that our website will be uninterrupted, error-free, or free from viruses or other harmful components.
SECTION 13 - LIMITATION OF LIABILITY
To the fullest extent permitted by Australian law, The Lessons & The Laughter will not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of our Services, including but not limited to loss of data or audio files after delivery, or any loss arising from circumstances outside our reasonable control.
Our total liability to you for any claim arising out of or in connection with these Terms or our Services will not exceed the amount you paid us for the session to which the claim relates.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded under Australian law.
SECTION 14 - PROHIBITED USES
You agree to use our Services and website for lawful purposes only. You must not:
Use our Services for any unlawful, harmful, or fraudulent purpose;
Infringe upon the intellectual property rights of The Lessons & The Laughter or any third party;
Transmit any viruses, malware, or harmful code through our website;
Attempt to gain unauthorised access to our systems or data; or
Use automated tools (including AI agents or scrapers) to access or extract content from our website without our prior written consent.

We may suspend or terminate your access to our Services at any time if you breach these Terms, with written notice where practicable. Upon termination, any outstanding payment obligations remain due.
You may cancel your booking in accordance with Section 3 above.

We may update these Terms of Service from time to time. The current version will always be available on our website. We will notify you of any material changes by email or by a prominent notice on our website. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
SECTION 17 - GOVERNING LAW
These Terms of Service are governed by the laws of the State of Victoria, Australia. You and The Lessons & The Laughter submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia sitting in Victoria for the resolution of any disputes.
SECTION 18 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed from these Terms and will not affect the validity or enforceability of the remaining provisions.
SECTION 19 - ENTIRE AGREEMENT
These Terms of Service, together with our Privacy Policy and any written booking confirmation, constitute the entire agreement between you and The Lessons & The Laughter in relation to your use of our Services, and supersede all prior agreements and understandings.
